1. Service requests
The service is free.
A person wishing to obtain a permit for the acquisition of individuals of non-hunted species shall submit a submission to the Natural Protection Board (hereinafter - the Office) in conformity with the specified sample of the form.
Any person, also a State or local government authority, who requests to apply an exemption in the cases referred to in Section 14, Paragraph one and two of the Law on the Protection of Species and Habitats, shall submit information (in a free form) to the Board, in which the following shall be indicated:
1) the reasons for this exception, including the type of risk, the alternatives evaluated and the scientific data used for the species to which the exception applies;
2) means, devices, techniques or measures intended to kill or capture individual individuals, as well as the reasons and restrictions for their use;
3) the time and place conditions under which the derogation applies, as well as other conditions for the application of the derogation.
2. Receipt of services
The Office shall inspect the legality and scientific justification of the activity indicated in the application and the documents appended thereto prior to the issuance of the permit for the acquisition of individuals of non-hunted species.
The Office shall not issue a permit for the acquisition of individuals of non-hunted species if:
1) the planned acquisition is in contradiction with the regulatory enactments regarding the acquisition and disturbance of individuals of specially protected species;
2) the applicant for the permit has not submitted a report regarding the previously performed acquisition.
The Office is entitled to withdraw the permit for the acquisition of individuals of non-hunted species if:
1) false information regarding the planned activity has been indicated in the application;
2) the acquired individuals of non-hunting species shall be used in a manner which is inconsistent with the purposes specified in the referred to submission;
3) the conditions referred to in the permit for the acquisition of individuals of non-hunted species are not observed.
A person who has received a permit for the acquisition of individuals of non-hunted species shall, within 30 days after the expiry of the period of validity of the permit, submit a report to the Office regarding the individuals of the unhunted species acquired.
Upon receiving information regarding the need for individuals of specially protected species to be acquired or disturbed in exceptional cases, the Board shall decide on:
1) its application to the relevant species;
2) means, methods, devices or techniques permitted for the capture or killing of individuals;
3) the time and place conditions under which the derogation applies, as well as other conditions for the application of the derogation;
4) the necessary monitoring measures.
